The trial of a Penticton man accused of stealing a vehicle is being extended due to a Charter Rights challenge.
Daniel Patrick Quinn is charged with breaking and entering with the intention of committing an offence, motor vehicle theft, driving while disqualified and breaching his probation order.
The charges, filed in June 2020, stem from an incident on Sept. 16, 2019, according to testimony given in court.
Defence for Quinn called that an ‘unusual’ delay before the filing of the report to Crown Counsel.
Jesse Shawcross is also facing charges in relation to the same incident, however, he did not appear in court.
Quinn appeared from custody for trial in Penticton’s Law Courts on May 19.
An adjournment was granted to allow the judge time to review case law from both defence and Crown prior to their Charter Rights argument and closing submissions.
According to Const. Garret Fast, who testified at the trial, the RCMP received a call from a resident who reported her SUV had been stolen from the underground parking garage where she lived.
The vehicle was recovered in Grand Forks in October 2019, and surveillance of the theft was retrieved shortly after.
The video showed three individuals, one male who used a tool to open the door to allow for a second male and female to get inside the building.
Another constable identified the two men sometime in November, which was then forwarded on to Crown counsel as part of the report in June of 2020.

In March 2020, Quinn was found guilty of stealing a vehicle from Osoyoos, assaulting a police officer, driving while disqualified and breaching his probation order.
Quinn is currently scheduled to return to Penticton’s Law Courts to fix a date for the half-day continuation of his trial.
