Sentencing delayed in Penticton child sex abuse images case

A Penticton man likely has another few months wait ahead of him before he can be sentenced for possession of child sexual abuse material.

Crown counsel and defence for Christopher Donald Vern Davis appeared in Penticton Provincial Court on Monday, April 8 to go over the matter.

Originally Davis had been set to be sentenced in October of 2023 after he was found guilty at trial earlier that year for possessing more than 300 images that met the definition of child sexual abuse material.

However, serious errors were found in the presentence report that raised concerns from Crown, defence and the presiding judge.

The report was sent back to the assessor in order to get a corrected risk assessment for Davis, and the judge also ordered the release of transcripts from a sealed file involving Davis from Salmon Arm.

The judge informed Crown and defence on Monday that the transcript had been released to her, and that she would be forwarding it on to them shortly.

Still outstanding was the judge’s request for a psychological assessment for Davis, which had been explicitly ordered for inclusion in the report by the judge.

Defence informed the courts that after speaking with the assessor, the court would need to directly subpoena the information from the Forensic Psychiatric Services Commission.

The judge issued a court order for the documents and noted the importance of moving ahead to sentencing. The next planned date for the sentencing is in June.

“I don’t want anything further to interfere with this matter unfolding at least as quickly as it’s been currently scheduled,” said the judge.

The sentencing is expected to take most of a day of the court’s time with testimony and cross-examination of the doctor who prepared the presentence report on Davis.
