Notice on title issued against property north of Summerland

Building permit has not been issued for work on property near Summerland

The Regional District of Okanagan-Similkameen has issued a notice on title on a property on North Beach Road, north of Summerland, but held off on approving injunctive action. 

The property, a 1.35-hectare parcel, is nine kilometres north of Summerland and is outside of the municipality's jurisdiction, but lies within the regional district’s area.

The notice on title was issued at the Oct. 3 regional district board meeting, over a structure on the property that was placed without building permits.

The construction of a single family dwelling with a deck was noted on Nov. 9, 2021. A stop work order was then placed and construction was ordered to be stopped.

One year later, on Nov. 9, 2022, the regional district sent a letter to the registered owner, advising of the stop work order and requirements to obtain a permit.

In March 2023, one owner came to the regional district office and advised that the unit is a camp trailer under renovation and is fully insured as a recreational vehicle in Alberta. 

He told the regional district the unit would stay on the property and would be moved occasionally to go to his property on the lake.

A rock slide in the area later in 2023 closed the highway near the property, and led to geotechnical reviews and a moratorium on building permits for properties in the area. 

At the regional district meeting, the unit was described as a self-made trailer, not a recreational vehicle.

According to the regional district, no building permit application has been made for this structure.

At the regional district meeting, the owner said he is not able to get building permits, as building permits are still not being issued due to the slide, and that the trailer had been planned to be used as a build-site office while construction was done a permanent house on the property. 

The regional district board issued a notice on title for this property, which will come up if someone were to express interest in purchasing the property.

However, a staff recommendation to take enforcement action after Oct. 31 was rejected.
